Real Estate Brands Ltd. (“ROOST Real Estate Co., “Lucky Town Real Estate Co.” “us,” we,” or “our”) values its customers’ privacy concerns. This Privacy Policy (the “Policy”) describes how the information that you share on our website (the “Service”) with us is handled.

Please note, Real Estate Brands Ltd. is a franchisor that d/b/a ROOST Real Estate Co. (“ROOST”) and Lucky Town Real Estate Co. (“Lucky Town”). ROOST and Lucky Town franchisees provide many of the services advertised on our Services. When you choose to provide your Personal Information to us, we are collecting this information on behalf of ourselves, our parent company, subsidiaries and other entities under our common control and our franchisees (collectively “Related Parties”). Your use of our website indicates your agreement to have your information shared with the Related Parties, some of which may have data use or handling process that differ from those described in this Policy.

Information Collection and Use

We collect several different types of information for various purposes to provide and improve our Service to you.

Types of Data Collected

Personal Information. While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Information”). Personal Information may include, but is not limited to: Email address; First name and last name; Phone number; Address, State, Province, ZIP/Postal code, City; Tracking & Cookies Data and Usage Data

Usage Data. We may also collect information how the Service is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Tracking & Cookies Data. We use cookies and similar tracking technologies to track the activity on our Service and hold certain information.

Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service.

Use of Data

We primarily use the information you provide to us to customize your online experience and to do what you have asked of us. We also use your Personal Information to tell you about our products and services.  On occasion, we use your Personal Information to validate your identity. As for Usage Data, we primarily use that information to operate and improve our consumer applications, and to further our marketing efforts. Generally, we do not share your information with unaffiliated or unrelated third parties. We do, however, share your information with our own personnel, members of our real estate brokerage network and our service providers to the extent necessary to fulfill your requests. We do not share your information with unaffiliated third parties for direct marketing purposes. We reserve the right to disclose your information under limited circumstances, such as to cooperate with law enforcement or judicial authorities as required by law or legal process, to protect our own legal rights, or to protect the public good.

Please note that we will retain the information we collect from you for as long as needed to provide the services you request and to comply with our legal obligations, resolve disputes and enforce our agreements.

Whenever you are online or on our applications, you run the risk that the information you give out will fall into the wrong hands. Although we implement and maintain commercially reasonable security procedures and practices to safeguard your privacy, we cannot guarantee the security of any information you provide to us. We accept no responsibility or liability for the activities of third parties. By using our consumer applications and applications, you agree to our Terms of Use.

Transfer and Disclosure Of Data

Generally. Personal Information we collect may be shared with a variety of parties, depending upon the purpose for and context in which that information was provided.

Franchisees. When you provide information while searching for a property, we may share that information with a ROOST or Lucky Town franchise office. Additionally, if you request to be contacted by a ROOST or Lucky Town Agent or office, we will disclose the Personal Information you provide to those parties in order to satisfy your request, including parameters of the search. While we place certain limitations on franchisees’ use of your Personal Information, these parties may have data use or handling practices that differ from those described in this Policy, and this Policy does not govern their use of your Personal Information. Please contact your agent or office directly or follow the links included in the communications you receive from them to learn more about their privacy practices.

Affiliates. Further, we reserve the right to share your Personal Information with our current or future Affiliates. We may also share your Personal Information and other information with trusted third parties for marketing, advertising, or other commercial purposes, and we may occasionally share your Personal Information with trusted parties who may have information that we believe will interest you. You may also request to receive information relating to third parties who are not affiliates or franchisees of ROOST, Lucky Town, or our Affiliates (such as mortgage brokerage partners, banks, or one of our partners, sponsors or service providers). In the event you request information from, or request to be contacted by such a third party, we will share your Personal Information with them. Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

Service Providers. We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Mergers & Acquisitions. In addition, if we go through a business transition, such as a merger, acquisition, liquidation or sale of all or a portion of our assets, Personal Information will, in most instances, be part of the assets transferred, or may be disclosed (subject to confidentiality restrictions) during the due diligence process. If such a transfer occurs, the acquiring company’s use of your Personal Information will still be subject to this Policy and the privacy choices you have made.

Legal Disclosures. Your Rights Regarding Your Personal Information

EU Residents:

Correction or update: You may ask us to change, update or complete any missing data we process about you, by contacting us with the relevant updates.

Erasure: We only process your Personal Information with your consent. You may withdraw your consent to our processing of your Personal Information at any time. Unless we believe we have a legitimate interest for continuing the processing of your Personal Information (e.g. to comply with our legal obligations, resolve disputes, enforce our agreements, etc.) and the Personal Information is no longer necessary in relation to the purpose for which it was originally collected, we will erase your data.

Portability: You have the right to receive a copy of your Personal Information in a structured, machine-readable format.

Children’s Privacy

Our Service does not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from children without verification of parental consent, we take steps to remove that information from our servers.

Limitation of Liability

By providing us with any Personal Information, you expressly and unconditionally release and hold harmless Real Estate Brands Ltd. and each of their Related Parties, parents, service providers, licensors, and its or their respective officers, directors, employees or agents (collectively the “Real Estate Brands Parties”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected Personal Information. In addition, while we take reasonable steps to prevent third party companies from making unauthorized use of your Personal Information, we cannot be held be held liable for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected Personal Information by those third parties.

UNDER NO CIRCUMSTANCES SHALL ANY REAL ESTATE BRANDS PARTIES BE LIABLE FOR ANY DAMAGES (INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, CONSEQUENTIAL, LOST PROFITS OR LOST REVENUE) THAT RESULT FROM THE USE OF THE INFORMATION OR MATERIALS ON THIS SITE, EVEN IF THE REAL ESTATE BRANDS PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

International Users

Our consumer applications are hosted by servers in the United States. If you are located outside of the United States, your Personal Information will be transferred to the United States for storage, processing and use. By submitting your Personal Information, you consent to its transfer to the United States and to its storage, processing, and use in the United States in accordance with this Policy. Your consent to this Policy followed by your submission of such information represents your agreement to that transfer.
